En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. El objetivo de este trabajo será responder si las potestades de la DGA son idóneas para paliar los efectos de la sequía, a través de tres secciones: primera, Identificación de la sequía como fenómeno fáctico multifactorial y su tratamiento en el CAg; segunda, revisión de las potestades de la DGA de acuerdo al artículo 314 CAg; tercera, revisión de la normativa que incorpora el usos prioritario del aguas y derecho humano al agua, cuya metodología será principalmente descriptiva, a través del (...) método dogmático basado en la legislación y la doctrina, igualmente el método exegético para establecer el sentido de conceptos técnicos. The assembly of products or components by operators in industries is a complex task with recurring problems. In these processes, operators often make errors that can lead to defective products. Therefore, they need to be inspected later to verify their correct assembly. The main problems are caused by several reasons including high employee turnover, lack of experience in manufacturing specific products or confusion in interpreting instructions to assemble similar components. In this paper, a novel structured language aimed to describe the (...) required actions to manufacture a product in industrial assembly environments is presented. The main contribution is to provide a formal language to feed automatic systems that can verify through visual control whether the actions performed by the operator are carried out following the standard described by this language. In general, the use of this formal language will allow to minimize the negative impact of errors during assembly and to reduce waste in many forms in the industry. (shrink)

This paper proposes freedom as the condition of possibility for the construction of trust in human relationships. The methodology used is a review of the scientific literature of the most recent moral and political philosophy. As a result of the dialogue between different positions, it is discovered that freedom, despite being present in the act of trust, is forgotten in the discussion around trust, a forgetfulness that has as its main causes the assumption that trust is natural and the confusion (...) between the propensity to trust and the act of trusting. All this leads to proposing an approach of the act of trusting that starts from the freedom of the trustee and the trustor. (shrink)

Esta investigación pone en diálogo las posiciones de Hobbes y de Spaemann respecto a la naturaleza de la confianza, para lo cual se asume una postura hermenéutica. Los principales resultados de esta arrojan que para Hobbes la confianza ha de ser aprendida, pues la desconfianza es lo primero con lo que se encuentra el ser humano; mientras que, para Spaemann, el hombre es un ser confiado y aprende a desconfiar. Como efecto de este diálogo se descubre que ambos autores tienen (...) como base para la confianza la sociabilidad humana, por lo cual se concluye que la disposición de la confianza se da en la naturaleza humana como condición de posibilidad para el acto de confiar. La prevención en materia ambiental, como concepto y principio, es una opción eficaz para aplicar el principio ético de responsabilidad esbozado por Hans Jonas, que propugna por un tratamiento responsable del ambiente de cara a su preservación para las generaciones venideras. En este sentido, la prevención es también un mecanismo de gestión que le da a cada riesgo ambiental el tratamiento particular que se merece, dadas sus características, premura e incluso potencial impacto en lo social, económico y ambiental. Esta obra (...) es una apuesta por un debate multidisciplinar sobre algunos de los temas vigentes de la gestión del riesgo ambiental, desde la incertidumbre y el análisis económico, hasta la reparación del mismo como un mecanismo disuasivo en la óptica de la responsabilidad civil. El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El libro busca aportar al estudio del daño ambiental desde los avances antes descritos en la materia. (shrink)

In this research, a sliding mode regulator with sine mapping is suggested for the stabilization of electricity generators being affected by magnet interaction nonlinearities and generator nonlinearities. To reach this goal, our suggested regulator has the following contributions: it starts from the sliding mode regulator with the modifications that the saturation mapping is used to reach a smoother performance instead of the signum mapping, and the sine mapping is applied to reach an upper bound in the proportional gain error, it (...) is used to reach some chosen constant behaviors for the angle position, angle speed, and current in the electricity generators, and its stabilization is ensured based on the Lyapunov approach. Casi todo lo que nos rodea implica riesgos de algún tipo, aunque no obstante es la cultura del riesgo la que ha coadyuvado al progreso y el desarrollo de la sociedad. El principio de precaución que no es ajeno a esta realidad, responde a la incertidumbre del riesgo, sin limitarse a expresar una actitud subjetiva del miedo. Es, un medio eficaz para la protección, en todo momento y de manera oportuna, de los recursos naturales, para así alcanzar el fin de (...) las normas ambientales. Este libro colectivo constituye a través de una juiciosa recopilación de experiencias de derecho comparado, y de un diálogo en torno a las tensiones que se dan, un llamado de atención para repensar el principio de precaución. El tratamiento de estas cuestiones por parte de los autores, tuvo por norte el equilibrio entre el desarrollo de la sociedad y la salvaguarda de los derechos que podrían afectarse por una situación de riesgo inminente; siempre de cara a la rigurosidad exigida por la ciencia. Esta obra permite al lector contar con valiosas herramientas para realizar una evaluación amplia del alcance actual del principio de precaución, tema que debe tener continuidad en pro de un mejor entendimiento de la gestión del riesgo y de las complejas circunstancias de la invocación y aplicación del principio que debe estar presente en la formulación de las políticas ambientales, dado que las autoridades y los particulares ante la falta de certeza científica absoluta, para impedir la degradación ambiental, deberán darle aplicación cuando exista peligro de daño grave e irreversible como lo establece la legislación colombiana (artículo 1 Ley 99 de 1993). Este paper examina en detalle el marco constitucional dispuesto en 1991 para la protección del medio ambiente y la configuración del Estado colombiano frente a los nuevos retos que plantea la protección ambiental. Lo anterior, a partir de dos elementos claves para entender el papel de los mecanismos jurídicos en la defensa de la naturaleza y el ambiente: la participación ambiental y el acceso a la justicia ambiental, ello, con el fin de conocer los instrumentos que reconfiguran el Estado para (...) que la ciudadanía y las organizaciones sociales puedan ejercer una defensa jurídica del medio ambiente, que aporte a la construcción de la justicia ambiental. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. En tal sentido, lo que se pretende evidenciar es la existencia de un panorama de (...) constitucionalización de los derechos ambientales con signicativos avances tales como el rol preponderante que ha adquirido el principio de precaución o el reconocimiento de la función ecológica de la propiedad. Jose Marti contributed greatly to Cuba's struggle for independence from Spain with words as well as revolutionary action. Although he died before the formation of an independent republic, he has since been hailed as a heroic martyr inspiring Cuban republican traditions.

Due to the difficulty in solving combinatorial optimization problems, it is necessary to improve the performance of the algorithms by improving techniques to deal with complex optimizations. This research addresses the metaheuristics of marriage in honey-bees optimization based on the behavior of bees. The current study proposes a technique for solving combinatorial optimization problems within proper computation times. The purpose of this study focuses on the travelling salesperson problem and the application of chaotic methods in important sections of the MBO (...) metaheuristic. Three experiments were conducted to measure the efficiency and quality of the solutions: MBO with chaos to generate initial solutions ; MBO with chaos in the workers ; and MBO with chaos to generate initial solutions and the workers. The application of chaotic functions in MBO was significantly better at solving the travelling salesperson problem. (shrink)

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera (...) de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. In this context, it is quite remarkable that a conference on Hispanic philosophy in the age of discovery should have been convened to examine the philosophical figures and treatises of the era. As it turns out, this volume represents probably one of the most enduring outcomes of the myriad activities of 1992. This is a volume that ranges widely into the philosophical world of the period, brings to light the richness and significance of philosophers and their work, and provides a coherent and consistently well-researched set of essays.The volume consists of fifteen essays divided into five parts. Part I consists of one essay by Jorge J. E. Gracia which offers a wide panorama of Hispanic philosophy from 1500 to 1650, as well as a lucid interpretation of the historical reasons why Hispanic philosophy seems to have reached a dead end in the context of modern European philosophy, and suffered the neglect of intervening centuries. Part II consists of one essay by Mauricio Beuchot on discussions concerning the conquest of Mexico; two essays by John Doyle and Marcelo Sánchez-Sorondo on the work of Francisco de Vitoria; and two essays on the celebrated dispute between Juan Ginés de Sepúlveda and Bartolomé de las Casas in 1550–51, the first by Eduardo Andújar and the second by Rafael Alvira and Alfredo Cruz. Part III includes essays by William Wallace on Domingo de Soto and Galileo’s science; Juan Antonio Widow on the economic thought of the Spanish Scholastics; Jean de Groot on the mysticism of Teresa de Avila; Yves Floucat on St. John of the Cross, and Mirko Skarica on the problem of future contingents. And yet these essays read well because the authors seriously undermine the conventional treatment of Sepúlveda as the hawkish defender of Indian slavery, and place him in the context of a larger Renaissance view of non-European peoples. Las Casas, in the view of the authors, had a great deal more in common with his opponent than the historiography has thus far suggested. In other sections of the volume, the variety of approaches and subjects on the part of the contributors challenges the reader to constantly shift grounds. Part III, for instance, takes us from the disquisitions on the velocity of falling bodies to the moral aspects of economic thought, and to the meaning of mystical theology. Fortunately, the competence of the researchers makes all individual pieces worthwhile even if this particular reviewer would have been somewhat more stringent with the space allotted to make a point.Contributors to this book leave no doubt as to the importance of their subjects, and yet they resist the temptation of exaggerating the extent of the influence of many of the Spanish authors on other European thinkers. I argue against theories that attempt to reduce scientific representation to similarity or isomorphism. These reductive theories aim to radically naturalize the notion of representation, since they treat scientist's purposes and intentions as non-essential to representation. I distinguish between the means and the constituents of representation, and I argue that similarity and isomorphism are common but not universal means of representation. I then present four other arguments to show that similarity and isomorphism are not the constituents of scientific representation. I (...) finish by looking at the prospects for weakened versions of these theories, and I argue that only those that abandon the aim to radically naturalize scientific representation are likely to be successful. Scientific representation is a currently booming topic, both in analytical philosophy and in history and philosophy of science. The analytical inquiry attempts to come to terms with the relation between theory and world; while historians and philosophers of science aim to develop an account of the practice of model building in the sciences. This article provides a review of recent work within both traditions, and ultimately argues for a practice-based account of the means employed by scientists to effectively achieve representation (...) in the modelling sciences. Resumo: O artigo a seguir tem como objetivo expor o pensamento hermenêutico de Friedrich Schleiermacher, levando em conta o contexto germinativo fértil de sua obra e sua influente posição filosófica, no âmbito do “primeiro romantismo alemão”. Schleiermacher renuncia a um importante fundamento transcendental a-histórico, em favor de uma compreensão situada, a qual se configura através do diálogo. A hipótese central deste artigo alerta que o desenvolvimento paralelo e sistemático das lições sobre ética, dialética e hermenêutica, em Schleiermacher, não é mera (...) coincidência, muito menos um sintoma isolado, senão que revela um projeto de caráter orgânico. Por um lado, será examinado - à luz de seus textos - o papel da linguagem como variável histórica e social para a compreensão e, por outro, algumas reflexões sobre as novas possibilidades de seu método hermenêutico e suas implicações, para a reflexão filosófica contemporânea.: The following article aims to expose the hermeneutic thought by Friedrich Schleiermacher, considering the fertile germinal context of his work and his influential philosophical position within the framework of “early romanticism”. Schleiermacher renounces an ahistorical transcendental foundation in favor of a situated understanding, which is configured through dialog. The central hypothesis of this article warns that the parallel and systematic development of the lessons on ethics, dialectics and hermeneutics in Schleiermacher is not a mere coincidence, much less an isolated symptom, but reveals a project of an organic nature. On the one hand, it is examined -in the light of their texts- the role of language as a historical and social variable for understanding and, on the other hand, some reflections on the new possibilities of his hermeneutical method and its consequences for contemporary philosophical reflection. Scientific representation is a booming field nowadays within the philosophy of science, with many papers published regularly on the topic every year, and several yearly conferences and workshops held on related topics. Historically, the topic originates in two different strands in 20th-century philosophy of science. One strand begins in the 1950s, with philosophical interest in the nature of scientific theories. As the received or “syntactic” view gave way to a “semantic” or “structural” conception, representation progressively gained the center stage. Yet, (...) there is another, older, strand that links representation to fin de siècle modeling debates, particularly in the emerging Bildtheorie of Boltzmann and Hertz, and to the ensuing discussion among philosophers thereafter. Both strands feed into present-day philosophical work on scientific representation. There are a number of different orthogonal questions that philosophers ask regarding representation. One set of questions concerns the nature of the representational relation between theories or models, on the one hand, and the real-world systems they purportedly represent. Such questions lie at the more metaphysical and abstract end of the spectrum—and they are often addressed with the abstract tools of the analytical metaphysician. They constitute what we may refer to as the “analytical inquiry” into representation. On the other hand there are questions regarding the use that scientists put some representations to in practice—these are questions that are best addressed by means of some of the favorite tools of the philosopher of science, including descriptive analysis, illustration by means of case studies, induction, exemplification, inference from practice, etc., and are best referred to as the “practical inquiry” into representation. The notion of representation invoked in such inquiries may be “deflationary” or “substantive”—depending on whether it construes representation as a primitive notion, or as susceptible to further reduction or analysis in terms of something else. In “The Toolbox of Science” (1995) together with Towfic Shomar we advocated a form of instrumentalism about scientific theories. We separately developed this view further in a number of subsequent works. Steven French, James Ladyman, Otavio Bueno and Newton Da Costa (FLBD) have since written at least eight papers and a book criticising our work. Here we defend ourselves. First we explain what we mean in denying that models derive from theory – and why their failure to do so should (...) be lamented. Second we defend our use of the London model of superconductivity as an example. Third we point out both advantages and weaknesses of FLBD’s techniques in comparison to traditional Anglophone versions of the semantic conception. Fourth we show that FLBD’s version of the semantic conception has not been applied to our case study. We conclude by raising doubts about FLBD’s overall project. (shrink)

This paper reviews four attempts throughout the history of quantum mechanics to explicitly employ dispositional notions in order to solve the quantum paradoxes, namely: Margenau's latencies, Heisenberg's potentialities, Maxwell's propensitons, and the recent selective propensities interpretation of quantum mechanics. Difficulties and challenges are raised for all of them, and it is concluded that the selective propensities approach nicely encompasses the virtues of its predecessors. Finally, some strategies are discussed for reading similar dispositional notions into two other well-known interpretations of quantum (...) mechanics, namely the GRW interpretation and Bohmian mechanics. I argue against an account of scientific representation suggested by the semantic, or structuralist, conception of scientific theories. Proponents of this conception often employ the term “model” to refer to bare “structures”, which naturally leads them to attempt to characterize the relation between models and reality as a purely structural one. I argue instead that scientific models are typically “representations”, in the pragmatist sense of the term: they are inherently intended for specific phenomena. Therefore in general scientific models are not (...) (merely) structures. I then explore some consequences of this pragmatist account of representation, and argue that it sheds light upon the distinction between theories and models. I finish by briefly addressing some critical comments due to Bas Van Fraassen. (shrink)

This paper argues for a representational semantic conception of scientific theories, which respects the bare claim of any semantic view, namely that theories can be characterised as sets of models. RSC must be sharply distinguished from structural versions that assume a further identity of ‘models’ and ‘structures’, which we reject. The practice-turn in the recent philosophical literature suggests instead that modelling must be understood in a deflationary spirit, in terms of the diverse representational practices in the sciences. These insights are (...) applied to some mathematical models, thus showing that the mathematical sciences are not in principle counterexamples to RSC. (shrink)

: This paper outlines a genuinely pragmatist conception of propensity, and defends it against common objections to the propensity interpretation of probability, prominently Humphreys’ paradox. The paper reviews the paradox and identifies one of its key assumptions, the identity thesis, according to which propensities are probabilities. The identity thesis is also involved in empiricist propensity interpretations deriving from Popper’s influential original proposal, and makes such interpretations untenable. As an alternative, I urge a return to Charles Peirce’s original insights on probabilistic (...) dispositions, and offer a reconstructed version of his pragmatist conception, which rejects the identity thesis. – Correspondence to: [email protected]. This paper expands on, and provides a qualified defence of, Arthur Fine's selective interactions solution to the measurement problem. Fine's approach must be understood against the background of the insolubility proof of the quantum measurement. I first defend the proof as an appropriate formal representation of the quantum measurement problem. The nature of selective interactions, and more generally selections, is then clarified, and three arguments in their favour are offered. First, selections provide the only known solution to the measurement problem (...) that does not relinquish any of the explicit premises of the insolubility proofs. Second, unlike some no-collapse interpretations of quantum mechanics, selections suffer no difficulties with non-ideal measurements. Third, unlike most collapse interpretations, selections can be independently motivated by an appeal to quantum propensities. This Element has two main aims. The first one is an historically informed review of the philosophy of probability. It describes recent historiography, lays out the distinction between subjective and objective notions, and concludes by applying the historical lessons to the main interpretations of probability. The second aim focuses entirely on objective probability, and advances a number of novel theses regarding its role in scientific practice. A distinction is drawn between traditional attempts to interpret chance, and a novel methodological study (...) of its application. A radical form of pluralism is then introduced, advocating a tripartite distinction between propensities, probabilities and frequencies. Finally, a distinction is drawn between two different applications of chance in statistical modelling which, it is argued, vindicates the overall methodological approach. The ensuing conception of objective probability in practice is the 'complex nexus of chance'. (shrink)

In debating the ethics of immigration, philosophers have focused much of their attention on determining whether a political community ought to have the discretionary right to control immigration. They have not, however, given the same amount of consideration to determining whether there are any ethical limits on how a political community enforces its immigration policy. This article, therefore, offers a different approach to immigration justice. It presents a case against legitimate states having discretionary control over immigration by showing both how (...) ethical limits on enforcement circumscribe the options legitimate states have in determining their immigration policy and how all immigrants (including undocumented immigrants) are entitled to certain protections against a state’s enforcement apparatus. This paper argues that if propensities are displayed in objective physical chances then the appropriate representation of these chances is as indexed probability functions. Two alternative formal models, or accounts, for the relation between propensity properties and their chancy or probabilistic manifestations, in terms of conditionals and conditional probability are first reviewed. It is argued that both confront important objections, which are overcome by the account in terms of indexed probabilities. A number of further advantages of the indexed probability account (...) are discussed, which suggest that it is promising as a general theory of objective physical chance. The paper ends with a discussion of the indexical character of the objective chances that are grounded in propensities. (shrink)

Multiple selves is a conventional assumption in behavioural welfare economics for modelling intrapersonal well-being. Yet an important question is which self has normative authority over others. In this paper, we advance an argument for what we call the ‘ontological approach’ to personal identity in behavioural welfare economics. According to this approach, ethical questions – such as which preference should be granted normative authority over another – can be informed by the ontological criterion of personal persistence, which aims at determining what (...) it takes for an individual to persist from one time to another.
